BY USING PERFUMICO SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU SHOULD NOT ACTIVATE YOUR ACCOUNT.

Perfumico.com asserts that the contents are genuine product independently rebottled and repackaged by Perfumico.com, Chicago, IL 60605. Perfumico.com is not associated in any way with the brand, designer or designer's manufacturer, and we have no contract or agreement authorizing us to rebottle or repackage the fragrance.

 

Perfumico may change these Terms and Conditions and the Privacy Statement at anytime, without notice. Such changes and their effective date will be posted on the Perfumico website at https://www.Perfumico.com and/or Perfumico will attempt to notify you of these changes through other means. You agree to review changes to these Terms and Conditions and the Privacy Statement and if any change is not acceptable to you, you agree to terminate use of Perfumico Services. Your continued use of Perfumico Services after the effective date of any such change constitutes your acceptance of all of the changes.

 

NOTE: Customers may purchase products from Perfumico only with the clear understanding that all products must be used at their own discretion, and only after referring to all information on https://www.Perfumico.com and other relevant technical information specific to the product. Perfumico shall not be held responsible for any damages to property or for any adverse physical effects (including injury or bodily harm).

Perfumico shall not be responsible for any damages resulting from use of or reliance upon this information. The user of the product is solely responsible for compliance with all laws and regulations applying to the use of the products, including the intellectual property rights of third parties.

The certifications, statements and product descriptions shown on this website are strictly for information purposes only. The information in this document is obtained from current and reliable sources but makes no representation as to its comprehensiveness or accuracy. Nothing contained herein should be considered as a recommendation by Perfumico as to the fitness for any use.

As with any fragrance use, Perfumico strongly recommends small skin testing for evaluation purposes prior to full use. As the ordinary or otherwise use(s) of this product is outside the control of Perfumico, no representation or warranty, expressed or implied is made as to the effect(s) of such use(s) (including damage or injury), or the results obtained.

The liability of Perfumico is limited to the value of the goods and does not include any consequential loss. Perfumico shall not be liable for any errors or delays regarding an order, or for any actions taken in reliance thereon.

You are responsible for all use of Your account and for the security of Your login identification so you should not transfer or permit any other person to use Your account for Perfumico Services.

You must be sixteen (16) years or older to use Perfumico services.

 

Referral Program: You must be an active Perfumico subscriber to redeem referral awards. Referrals are only valid on new subscribers only. Positive balances may only be used at Perfumico site. A positive balance on Perfumico.com does not have any cash value. Perfumico reserves the right to determine if a referral is invalid or fraudulent, including referring yourself. If the referral is deemed by Perfumico to be invalid or fraudulent, your account may be cancelled, all referral bonuses may be deducted from your account and all referral awards will be voided. Posting on message boards or spamming others is not allowed. Although Perfumico fully intends to keep https://www.Perfumico.com up and running, it may be possible at sometime to terminate the program. Should Perfumico have to terminate the program, all members would still have 30 days to complete transactions with their established referral bonuses. 30 days after the termination of the Perfumico Referral Program, all positive awards earned from the site will be lost.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD PERFUMICO, IT’S PARENT COMPANY, SUBSIDIARIES, AFFILIATES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, SUPPLIERS, AFFILIATES HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES AND COSTS (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS' FEES AND COURT COSTS) (COLLECTIVELY, "CLAIMS") ARISING OUT OF OR RELATING TO YOUR BREACH OF ANY OF THESE TERMS AND CONDITIONS OR USE (BY YOU OR ANY THIRD PARTY) OF PERFUMICO SERVICES, EXCEPT TO THE EXTENT SUCH CLAIMS DIRECTLY RESULT FROM PERFUMICO OWN NEGLIGENCE. THE FOREGOING INDEMNIFICATION OBLIGATION SHALL SURVIVE ANY TERMINATION OF THESE TERMS AND CONDITIONS OR OF PERFUMICO SERVICES PROVIDED TO YOU.

YOU ACKNOWLEDGE THAT PERFUMICO SERVICES ARE PROVIDED "AS IS, AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY WARRANTY WITH RESPECT TO THE QUALITY, PERFORMANCE OR FUNCTIONALITY OF PERFUMICO SERVICES OR WITH RESPECT TO THE QUALITY OR ACCURACY OF ANY INFORMATION OBTAINED FROM OR AVAILABLE THROUGH USE OF PERFUMICO SERVICES OR THAT PERFUMICO SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. PERFUMICO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

IN NO EVENT SHALL PERFUMICO BE LIABLE UNDER ANY SECTION OF THESE TERMS AND CONDITIONS OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF USE, LOST PROFITS, LOSS OF DATA OR INFORMATION OF ANY KIND OR LOSS OF BUSINESS GOODWILL OR OPPOR-TUNITY) WHETHER OR NOT PERFUMICO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES. PERFUMICO SHALL NOT BE LIABLE FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY AND IN NO EVENT SHALL PERFUMICO LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00). NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THESE TERMS AND CONDITIONS MAY BE BROUGHT BY YOU OR PERFUMICO MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION HAS ACCRUED.

Entire Agreement. These Terms and Conditions, the License Agreement and the Guidelines (the terms of which are hereby incorporated by reference) together constitute the sole agreement between Perfumico and You respecting the subject matter hereof and fully supersede any and all other agreements, either oral or in writing. You acknowledge and agree that You have read these Terms and Conditions, the License Agreement and the Guidelines and understand their terms.

Legal Actions. This Agreement and its validity, construction and performance shall be governed in all respects by the laws of the State of California. Exclusive jurisdiction and venue for all matters related to this Agreement shall be in the state of California, and the parties hereby agree and consent to such jurisdiction and venue.

Any claim or controversy that arises out of or relates to this Agreement, or the breach of it, shall be settled by arbitration in accordance with the rules of the American Arbitration Association. Judgement upon the award rendered may be entered in any court with jurisdiction.

Severability. If any provision of these Terms and Conditions is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to effect the original intentions of the parties, and the remainder of these Terms and Conditions shall remain in full force and effect.

No Waiver. Any failure of Perfumico to enforce any provision of these Terms and Conditions shall not constitute a waiver of any rights under such provision or any other provision of these Terms and Conditions.

YOU AND PERFUMICO AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and PERFUMICO agree otherwise, the arbitrator may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
